Negligence in Sexual Assault Cases
Institutions Have A Duty To Protect
Sexual assault became one of the leading stories in 2017, finally bringing this issue out of the hushed murmurs of furtive conversations and out from the pages of settlement deals and NDAs. However, just because these actions are starting to be reported on in the manner they deserve doesn’t mean that everyone involved is taking the necessary actions to protect potential victims. Far too many victims are assaulted by people whose actions were reported in the past. In these cases, the institution that heard these reports could be held liable for their failure to act.

Hewlett v. Utah State University et al
A recent case brought this issue to the forefront of conversation in Utah. Victoria Hewlett, a student at Utah State University, was raped by a fellow student, Jason Relopez. In the lawsuit filed against the university, Hewlett stated that five other women had come forward reporting that Relopez raped them. Relopez remained on campus until he was arrested following his rape of Hewlett. Federal campus-safety guidelines require schools that learn about potential sexual violence to determine what the continuing threat is to the safety of other people on campus, something Hewlett states they failed to do in her lawsuit against the USU and Relopez’s fraternity, Sigma Chi. You can read more about this case in the Salt Lake Tribune’s coverage here.
