Car collisions with cows and other livestock happen more often than you think, and the consequences of these crashes can be devastating.  Most of the collisions occur after nightfall when it is difficult to see cattle and other livestock on the road.  Many livestock owners live next to high-speed roads (e.g., Highway 89), which means drivers can have a very difficult time avoiding an accident – particularly at night.

Claims against livestock owners in Utah are governed by Utah Code Ann. Section 41-6a-407.  Utah law draws a distinction on liability for claims arising in “closed range” areas and those arising in “open range” areas.  Whether an area is closed range or open range can vary from county to county.  For example, Utah County is closed range whereas its neighbor to the south, Sanpete County, is open range.
